Lagos State Regional and Urban Planning Law, 2010
ENACTED BY THE LAGOS STATE HOUSE OF ASSEMBLY
IN THE YEAR TWO THOUSAND AND TEN
AS FOLLOWS:
Short Title
This Law may be cited as the Lagos State Regional and Urban Planning Law, 2010.
Interpretation
In this Law, unless the context otherwise requires:
- "Authority" means the Lagos State Urban Planning and Development Authority established under this Law;
- "Board" means the Lagos State Urban Planning and Development Board established under this Law;
- "Commissioner" means the Commissioner for Physical Planning and Urban Development;
- "Development" means the use of land for any purpose, including but not limited to residential, commercial, industrial, recreational, agricultural, or any other purpose;
- "Land" means any area of ground, whether or not covered with buildings, trees, or other structures, and includes any interest in or right over land;
- "Local Government" means a Local Government Area in Lagos State;
- "Minister" means the Minister responsible for Physical Planning and Urban Development;
- "Planning" means the process of preparing and implementing plans for the development of land and the use of buildings and structures;
- "Regional Plan" means a plan prepared by the Authority for the development of a region in Lagos State;
- "Urban Area" means an area of land that is densely populated and has a high level of economic activity, and includes any area that is designated as an urban area by the Authority;
- "Urban Plan" means a plan prepared by the Authority for the development of an urban area in Lagos State.
Establishment of the Authority
- There is hereby established an Authority to be known as the Lagos State Urban Planning and Development Authority.
- The Authority shall be responsible for the planning and development of land and the use of buildings and structures in Lagos State.
Functions of the Authority
- The Authority shall have the following functions:
- To prepare and implement Regional Plans and Urban Plans for the development of land and the use of buildings and structures in Lagos State;
- To regulate the use of land and the development of buildings and structures in Lagos State;
- To issue permits and approvals for the development of land and the use of buildings and structures in Lagos State;
- To monitor and enforce compliance with the provisions of this Law and any other law relating to planning and development in Lagos State;
- To provide advice and guidance to the Government and other stakeholders on matters relating to planning and development in Lagos State.
Establishment of the Board
- There is hereby established a Board to be known as the Lagos State Urban Planning and Development Board.
- The Board shall be responsible for the administration of the Authority and the implementation of the functions of the Authority.
Composition of the Board
- The Board shall consist of the following members:
- The Commissioner for Physical Planning and Urban Development (Chairman);
- The Permanent Secretary, Ministry of Physical Planning and Urban Development;
- The Director-General, Lagos State Urban Planning and Development Authority;
- Two representatives of the Local Governments in Lagos State;
- Two representatives of the private sector;
- Two representatives of the academic community;
- One representative of the Ministry of Environment;
- One representative of the Ministry of Works and Infrastructure.
Powers of the Board
- The Board shall have the following powers:
- To prepare and implement Regional Plans and Urban Plans for the development of land and the use of buildings and structures in Lagos State;
- To regulate the use of land and the development of buildings and structures in Lagos State;
- To issue permits and approvals for the development of land and the use of buildings and structures in Lagos State;
- To monitor and enforce compliance with the provisions of this Law and any other law relating to planning and development in Lagos State;
- To provide advice and guidance to the Government and other stakeholders on matters relating to planning and development in Lagos State.
Regional Plans
- The Authority shall prepare and implement Regional Plans for the development of land and the use of buildings and structures in Lagos State.
- The Regional Plan shall be prepared in consultation with the Local Governments, the private sector, and other stakeholders.
- The Regional Plan shall be reviewed and updated every five years.
Urban Plans
- The Authority shall prepare and implement Urban Plans for the development of urban areas in Lagos State.
- The Urban Plan shall be prepared in consultation with the Local Governments, the private sector, and other stakeholders.
- The Urban Plan shall be reviewed and updated every five years.
Permits and Approvals
- The Authority shall issue permits and approvals for the development of land and the use of buildings and structures in Lagos State.
- The permits and approvals shall be issued in accordance with the provisions of this Law and any other law relating to planning and development in Lagos State.
Penalties
- Any person who contravenes the provisions of this Law or any other law relating to planning and development in Lagos State shall be liable to a fine not exceeding N500,000 or imprisonment for a term not exceeding two years, or both.
Repeal and Savings
- The Lagos State Urban Planning Law, 1978 is hereby repealed.
- Notwithstanding the repeal of the Lagos State Urban Planning Law, 1978, any plan, permit, or approval issued under that Law shall continue to be valid and shall be deemed to be a plan, permit, or approval issued under this Law.
Commencement
This Law shall come into force on the date of its publication in the Official Gazette.
Short Title
This Law may be cited as the Lagos State Regional and Urban Planning Law, 2010.
APPROVED
This Law was approved by the Lagos State House of Assembly on the [insert date].
PUBLISHED
This Law was published in the Official Gazette of Lagos State on the [insert date].
