EDO STATE HEALTH LAW, 2017

AN ACT TO PROVIDE FOR THE PROMOTION, PROTECTION AND REGULATION OF PUBLIC HEALTH IN EDO STATE AND FOR OTHER CONNECTED PURPOSES

ENACTED BY THE EDO STATE HOUSE OF ASSEMBLY

CHAPTER I: PRELIMINARY

  1. Short title: This Law may be cited as the Edo State Health Law, 2017.
  2. Commencement: This Law shall come into force on the date of its publication in the Official Gazette.
  3. Interpretation: In this Law, unless the context otherwise requires: (a) "Authority" means the Edo State Ministry of Health; (b) "Board" means the Edo State Health Board established under this Law; (c) "Commissioner" means the Commissioner for Health in the Edo State Government; (d) "Director" means the Director of Public Health in the Edo State Ministry of Health; (e) "Health" means the physical, mental and social well-being of individuals and communities; (f) "Health facility" means any hospital, clinic, health centre, maternity home, dispensary, or any other place where medical or health services are provided; (g) "Health officer" means any person appointed or employed by the Authority to carry out the functions of the Authority under this Law; (h) "Minister" means the Minister of Health in the Edo State Government; (i) "Public health" means the health of the population as a whole, including the prevention of disease, the promotion of health, and the protection of the public from health hazards.

CHAPTER II: ESTABLISHMENT OF THE EDO STATE HEALTH BOARD

  1. Establishment of the Board: There is hereby established a Board to be known as the Edo State Health Board, which shall be responsible for the promotion, protection and regulation of public health in Edo State.
  2. Composition of the Board: The Board shall consist of the following members: (a) The Commissioner for Health (Chairman); (b) The Director of Public Health; (c) The Permanent Secretary, Ministry of Health; (d) The Medical Director, University of Benin Teaching Hospital; (e) The Medical Director, Central Hospital, Benin City; (f) The Medical Director, Stella Obasanjo Hospital, Benin City; (g) The Representative of the Nigeria Medical Association, Edo State Branch; (h) The Representative of the Pharmaceutical Society of Nigeria, Edo State Branch; (i) The Representative of the Edo State Traditional Medicine Practitioners Association.

CHAPTER III: FUNCTIONS OF THE AUTHORITY

  1. Functions of the Authority: The Authority shall have the following functions: (a) To promote and protect the health of the people of Edo State; (b) To prevent and control the spread of diseases; (c) To provide health education and health promotion services; (d) To regulate the practice of medicine, pharmacy, nursing and other health professions; (e) To establish and maintain health facilities and services; (f) To provide for the training and development of health personnel; (g) To collaborate with other government agencies, organizations and individuals to promote public health.

CHAPTER IV: HEALTH FACILITIES

  1. Registration of health facilities: Every health facility in Edo State shall be registered with the Authority.
  2. Inspection of health facilities: The Authority shall have the power to inspect any health facility to ensure compliance with the standards and regulations established by the Authority.

CHAPTER V: HEALTH OFFICERS

  1. Appointment of health officers: The Authority shall appoint health officers to carry out the functions of the Authority under this Law.
  2. Powers of health officers: Health officers shall have the power to: (a) Inspect health facilities; (b) Investigate health complaints; (c) Conduct health education and health promotion activities; (d) Enforce the provisions of this Law.

CHAPTER VI: FINANCIAL PROVISIONS

  1. Funding: The Authority shall be funded by the Edo State Government and other sources as may be approved by the State Government.
  2. Budget: The Authority shall prepare an annual budget which shall be submitted to the State Government for approval.

CHAPTER VII: MISCELLANEOUS PROVISIONS

  1. Offences: Any person who contravenes any provision of this Law shall be guilty of an offence and shall be liable on conviction to a fine or imprisonment or both.
  2. Regulations: The Authority may make regulations for the purpose of giving effect to the provisions of this Law.
  3. Interpretation: The Authority shall have the power to interpret this Law and its regulations.

CHAPTER VIII: SHORT TITLE AND COMMENCEMENT

  1. Short title: This Law may be cited as the Edo State Health Law, 2017.
  2. Commencement: This Law shall come into force on the date of its publication in the Official Gazette.
